These Terms of Service ("Terms") govern your access to and use of the VistaHire platform (the "Service"), operated by Hunt, Guillot & Associates, LLC ("HGA," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
The Service is an internal applicant tracking system provided for use by authorized HGA personnel and designated third parties (collectively, "Users"). Access is granted by HGA administrators through account provisioning or Microsoft single sign-on. The Service is not available for general public registration.
You agree to use the Service only for its intended purpose of managing hiring and recruitment activities. You shall not:
Users who enter, upload, or manage candidate personal information through the Service are responsible for ensuring that such data is accurate, collected lawfully, and used only for legitimate hiring purposes. Candidate resumes and personal data must be handled in accordance with HGA's data handling policies and applicable privacy laws.
The Service may include SMS messaging functionality for communicating with candidates regarding hiring activities (e.g., interview scheduling, status updates). Users who send SMS messages through the Service must ensure that recipients have provided appropriate consent. Message frequency varies based on hiring activity. Message and data rates may apply to recipients. Recipients may opt out at any time by replying STOP. We do not use phone numbers or messaging data for marketing or promotional purposes unrelated to the Service.
The Service, including its design, software, text, graphics, and all related intellectual property, is owned by Hunt, Guillot & Associates, LLC or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as authorized. Content uploaded by Users (e.g., resumes, documents) remains the property of its respective owner.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify HGA immediately of any unauthorized use of your account or any other breach of security.
HGA may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to access the Service ceases immediately.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. HGA does not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, HGA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Service.
The Service is a tool to assist with hiring workflows. All hiring decisions are made by authorized HGA personnel or client representatives and are not made or recommended by the Service. HGA is not responsible for hiring outcomes based on data managed through the Service.
The Service integrates with third-party service providers (such as cloud hosting, authentication, messaging, and AI processing providers) to deliver its functionality. Your use of the Service may be subject to the terms and privacy policies of these third-party providers.
We reserve the right to modify these Terms at any time. We will notify Users of material changes by posting updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of laws provisions.
